Welcome to the website of Petal & Poke, LLC. These Terms of Service explain how petalandpoke.com, along with its appointment booking features and services, may be used. By visiting the site or scheduling a service, you agree to be bound by the terms below. If any of them don't work for you, please don't use the website or book appointments.

1. In-Home and Telehealth Services

Petal & Poke, LLC offers in-home acupuncture and telehealth herbal medicine.

  • Eligibility: To book treatment in your residence, you must be at least 18 years old.

  • Home Visit Environment: Please provide a clean, safe, and smoke-free space for home visits. Petal & Poke may decline treatment or end an appointment early if the environment appears unsafe, hazardous, or hostile.

  • Telehealth Requirements: Telehealth appointments work best with a private, reasonably quiet space and a reliable internet connection. Technical issues can occasionally affect the quality or continuity of a visit.

The information on this website is for general informational purposes only. It is not a substitute for medical advice, clinical diagnosis, or emergency medical care.

Browsing this website or booking a service does not, on its own, establish a practitioner-patient relationship. For any specific symptoms or health conditions, please consult your primary care physician or a qualified healthcare specialist.

3. Booking, Cancellation, & Payment Policies

  • Scheduling & Payment: Appointments are requested and confirmed through a third-party scheduling integration (Jane). Accepted payment methods are major credit and debit cards, cash, and Health Savings Account (HSA) and Flexible Spending Account (FSA) cards. Please check with your plan administrator to confirm whether services qualify for reimbursement under your specific HSA/FSA plan.

  • Insurance & Superbills: Petal & Poke is an out-of-network provider and does not bill insurance companies directly. Once services have been paid in full, a superbill (an itemized medical receipt) can be provided on request for you to submit to your insurance company for potential reimbursement. Reimbursement is not guaranteed.

  • Cancellation Policy: Because a booking reserves time set aside just for you, appointments cancelled with less than 24 hours' notice are charged at 100% of the treatment cost. The same applies if you are not at the location, cannot be reached, or have not joined a telehealth session within 15 minutes of the scheduled start time. Cancellation fees are not eligible for superbills. If you're running late or something unexpected comes up, please reach out as soon as possible. Petal & Poke will gladly work with you to find a solution.

4. Prohibited Uses

Please do not use the site or its content to: (a) engage in any unlawful purpose; (b) encourage others to take part in unlawful acts; (c) infringe or violate the intellectual property rights of Petal & Poke or others; or (d) upload or transmit viruses or other malicious code that could affect the functionality or operation of the Service or any related website.

5. Limitation of Liability

Petal & Poke, LLC, its directors, officers, employees, and practitioners are not liable for any injury, loss, claim, or damages of any kind, whether direct, indirect, incidental, punitive, special, or consequential, including lost profits, lost revenue, or replacement costs, arising from the use of any services or any products obtained through the services.

6. Governing Law

These Terms of Service, and any separate agreements under which services are provided to you, are governed by the laws of the State of Colorado, without regard to conflict of law principles. Any legal actions arising from these terms or the services must be brought in the appropriate courts located in Colorado.

The most current version of these Terms of Service is always available on this page. Petal & Poke may update, change, or replace any part of these terms at its discretion by posting changes to the website. Please check back periodically for updates.
